Agreement Cases of Palestinian Non-Compliance
January 12, 1999
1.The PA has organized violent demonstrations and incited
violence.
2.Incitement in the controlled media continues unabated.
Deliberations in the trilateral committee on incitement seem
useless. No action has been taken against continuing
incitement, which includes anti-Semitic propaganda.
3.The threat to unilaterally declare a Palestinian state with
Jerusalem its capital contravenes the provision that "all
outstanding issues relating to permanent status will be
resolved through negotiations" and the U.S. policy statement
that such unilateral declaration is courting disaster.
4.The Palestinians have not submitted the security work plan
which was supposed to be submitted every two weeks.
5.The list of those detained of the 30 wanted terrorists. We
have neither names nor American verification of
incarceration.
6.Revolving door policy on arrested terrorists continues.
7.Israel has not yet received the list of policemen over the
prescribed number of 30,000 and the list of those who left
the police force.
8.Israel knows nothing about the confiscation of illegal
weapons. No data on what has been collected, how the
weapons have bee disposed of, and on whether the activity
is continuing.
Israel has no proof that weapons have been collected and
destroyed. We have received no report on illegal weapons in
the hands of the PA police.
The Palestinians have been refusing to discuss the criteria
and modalities of weapons licensing.
Arafat has said that there are at least 30,000 illegal pieces in
Gaza alone. We know Ghazi Jebali is not treating the matter
seriously.
9.Security cooperation is spotty. Palestinian security services
act almost exclusively on information we give them, almost
never showing initiative. The cooperation is better with
Muhammed Dahlan in Gaza than with Jibril Rajoub in Judea
and Samaria.
10.Hebron is a particularly sensitive problem. Use of firearms is
frequent - including the most recent which injured three
women. Israel knows all perpetrators escaped to PA area -
Israel has no report on the matter from the PA, nor a
condemnation of the attacks.
The special bilateral committee on Hebron - formed at
American request - has met only once, and has not
influenced the situation on the ground.
11.Violating agreement at Gaza Airport - preventing inspection
of Egyptian plane with Arafat entourage.
12.The outlawing of terrorist organizations may be on the
books, but nothing is done to implement the decrees and to
punish those belonging to the organizations.
13.The Palestinians have failed to appoint representatives to the
following: the Trilateral Committee on the unauthorized
introduction of weapons to PA areas; the Legal Committee;
the Standing Cooperation committee (which addresses,
among others, "people to people" programs); the Third FRD
committee.
Cases of Palestinian Compliance with Wye
1.Charter articles cancellation.
2.Decrees on arms collection an incitement.
3.Apparent beginning of some weapons confiscation. We don't
know how much and what has been done with it.
