The Public Prosecution will close the Netanyahu case," said a senior legal source yesterday after the Jerusalem district prosecution described the case as "complex and problematic." The Attorney General and the State Prosecutor are expected to embrace the recommendations of Jerusalem District Attorney, Moshe Lador, who feels that the evidence collected by the police is insufficient to bring about the certain conviction of former prime minister Benjamin Netanyahu. The Jerusalem District Attorney's office leans toward recommending that the case against Netanyahu be closed. Ma'ariv has discovered that on Sunday of this week, a meeting was held in the Public Prosecutor's office, attended by State Prosecutor Edna Arbel, Head of the Criminal Division, Nava Ben Ohr, Lador, and the attorney working closely on the case, Shlomo (Momi) Lamberger. The meeting lasted a few hours and during the meeting, Lador and Lamberger explained their views and gave their opinion on the case. They explained why they recommend that the case be closed for lack of sufficient evidence. The two attorneys also explained that the testimony of the key witness, moving contractor Avner Amedi, was problematic and that there was not enough supporting evidence to corroborate his testimony. They added that it was a complex and problematic legal case and that the chances of obtaining a conviction based on it were borderline and doubtful. For these reasons, they said, they were left with no choice but to recommend that the case be closed for reasons of insufficient evidence. A senior official in the Public Prosecutor's office said yesterday that in his opinion, following Lador's recommendation not to indict, it would be impossible to serve charges against Netanyahu, and that in his view Attorney General Elyakim Rubhinstein and State Prosecuter Arbel would act on Lador's recommendation. In closed forums, Arbel has already made her opinion known, saying that if there is any doubt, it should work in Netanyahu's favor, and that a former prime minister or any other senior political figure should not be indicted unless matters are unequivocal and clear cut. A senior legal source said that the treatment of the case is "shrouded in secrecy," and that even senior officials in the Public Prosecutor's office did not know what was going on. The same source said that in his view the final decision to close the file would be made in a few weeks' time. He added that Rubinstein and Arbel would explain the decision in a detailed report.
